Notification
The 20th

No. G.S.R. 78/C.A. 17/93/S. 12/Amd.(3)/2001:- In exercise of the powers conferred by section 12 of the Lotteries
(Regulation) Act, 1998 (Central Act 17 of 1998), and all other powers
enabling him in this behalf, the Governor of Punjab is pleased to make
the following rules further to amend the Punjab State Lottery Rules,
1998:- |
| 1. |
(i) |
These rules may be called the Punjab State Lottery (First
Amendment) Rule, 2001. |
| |
(ii) |
They shall come into force on and with effect from the date of their
publication in the Official Gazette |
| 2. |
|
In
the Punjab State Lottery Rules, 1998 (hereinafter referred to as the
said rules), in rule 1, in sub-rule (1), for the word “Lottery”, the
word “Lotteries” shall be substituted |
| 3. |
|
In the said rules, in rule 2:- |
| |
(i) |
in clause (j), at the end, for the word and sign
‘Government; the following words and signs shall be substituted,
namely:-
|
| |
|
“Government including
On-line Lottery which is envisaged to offer lottery games played through a network of computer
terminals installed at retail locations, with
the terminals connected to a main data centre at a central
headquarter”, |
| |
(ii) |
in
clause (k), in the third line, for the word “recommendation”, the word
“recommendations” shall be substituted and |
| |
(iii) |
in clause
(l) at the end, for the word and sign “lottery’, the following words and
sign shall be substituted, namely:- |
| |
|
“lottery including tickets released by different/authorized
outlets with respect of On-Line
Lottery”. |
| 4. |
|
In
the said rules, in rule 4, in sub-rule (1), for the words “for which”,
the words “or by setting up a Central Information and processing Centre
which will be connected on line to all outlets using state of the art
communication network. For the selection of Agent” shall be substituted |
| 5. |
|
In the said rules, in
rule 5:- |
| |
(i) |
in
sub-rule (2), at the end, for the words and sign “agreed upon,” the
words and sign “agreed upon and through the authorized outlets with
respect to the on line lottery,” shall be substituted; |
| |
(ii) |
in
sub-rule (4), at the end, for the word and sign “ticket”, the following
words and signs shall be substituted, namely:- |
| |
|
“ticket, However, with
respect of the On-Line Lottery, the number chosen by the purchaser shall
be printed/allotted by the outlet holder by means of computer/any
other approved device, from the number already
approved/earmarked for a particular draw of the On-Line Lottery,”
and |
| |
(iii) |
sub-rule (6), shall be omitted and sub-rule (7)
shall be re-numbered as sub-rule (6). |
| 6. |
|
In
the said rule 7, in sub-rule (2), for the words, figures and signs “9.00
A.M. to 4.30 P.M.”, the words figures and signs “6.00 A.M. to 9.00 P.M.”
shall be substituted. |
| 7. |
|
In
the said rules, in rule 8:- |
| |
(i) |
in sub-rule (1), for the words “a period of thirty
days from the date of execution of agreement:, the words “such period as
specified/mentioned in the terms and conditions of a particular lottery”
shall be substituted; and
|
| |
(ii) |
in
sub-rule (2), at the end, for the word and sign “behalf”, the following
words and sign shall be substituted, namely:- |
| |
|
“behalf or by depositing requisite agent fee as per the
provisions of the terms and conditions of the lottery”. |
| 8. |
|
In
the said rules, in rule 9, for the words, “thirty days”, the words “such
period as agreed by way of agreement” shall be substituted. |
| 9. |
|
In
the said rules, for rule 10, the following rule shall be substituted,
namely:- |
| |
|
“10”. Publication of results:-
the result of the draw will be got published by the Director in various newspapers as well as the Punjab Government
Gazette or/and would be
made available on the outlets. A certified copy of the result shall be supplied to the agents immediately after the
draw.” |
| 10. |
|
In
the said rules, in rule 12, at the end, for the words and sign “winning
tickets,” the following words and signs shall be substituted, namely:- |
| |
|
“winning tickets or to carry out a due diligence, if need be, on
the selected bidder.” |
| 11. |
|
In
the said rules, for rule 15, the following rules shall be substituted,
namely:- |
| |
|
“15”.
Forged or torn out tickets:- |
| |
(i) |
A ticket which is forged, torn out, mutilated or tampered with, shall not be enter-tained. |
| |
(ii) |
In case of any doubt, the
Director may get the tickets verified from
the printing press or by a forensic science laboratory or any other authority. |
| |
|
“15.A”.
Mod of Disbursement of payments:- |
| |
(i) |
All the prize winning tickets holders shall be paid in Indian currency |
| |
(ii) |
One ticket will enable the
holder thereof to claim one prize only, "whichever is higher.” |
| 12. |
|
In the said rules, in rule 18, in the third line,
for the word and sign “agent”, the words and sign “agent” or his duly
authorized outlet holder,” and in the fourth line, for the word “by” the
word “from” shall be substituted.

| 13. |
|
In
the said rules, for rule 20, the following rule shall be substituted,
namely:- |
| |
|
“20”. Arbitrator:- In case of
any dispute having arisen action or decision having
been taken under the rules, the same shall be referred to the
Secretary to the State Government in the Department of Finance,
as a Sole Arbitrator and his decision
thereon shall be final and binding”. |
| 14. |
|
In the said rules, after rule 22, the following
rules shall be added, namely:-
|
| |
|
“23”. Right to issue instructions:- The State
Government shall have all rights to
issue any instructions from time to time for the matters which may not
be specifically covered under these rules
for the smooth functioning of its lotteries
including On-Line Lottery and all instructions so issued by
the State Government will be read in cohesion with rules, provisions of
the Act, terms condition laid
down in the Tender Document-Invitation of Bids for On-Line Lottery
System and also with the; terms and conditions entered
in the other tender notices agreements. All such instructions shall have the force of law and will be
binding on all concerned”. |
